My story:
With the downturn in the economy, finding myself without savings and no money coming in, trusted people in my life recommended I file bankruptcy.
There was a lot of emotion, shame, regrets and the fear of wrecking my credit for 10-years that came along with my decision to file bankruptcy.
My first goal was to do online research to save money and file "in pro per" (representing myself, without hiring an attorney). I quickly learned that the costs would be $300 to $500 for the bankruptcy kit, insurmountable paperwork, the risk of misfiling, plus Court filing fees and credit counseling courses. I was looking at close to $1,000, not to mention the hours and hours it would take for me to file by myself.
Plan B -- hire a Bankruptcy Attorney
My experience of interviewing (3) three attorneys whose claim to fame (according to their websites) was low cost, quick and good track record for bankruptcy to be approved by court. NOTE: there is no guarantee your bankruptcy will be approved; each case has its own nuances.
1. The first attorney I spoke with on the phone. He seemed arrogant, impatient, impartial, impersonal, matter of fact, and not sympathetic to my situation. It seemed all he cared to talk about was his fee of $1,560 to $1,700 plus court filing fees and $150 for 2-Mandatory consumer credit counseling courses ($75/each course x 2)
2. The second attorney's website claimed he was the lowest cost and the best there was operating in San Mateo and Santa Clara Counties. His claim to fame seemed so real that with time of the essence the day I called him he was in his San Jose office. I risked driving 2-hours round trip. On my drive down to San Jose I received a call from his exchange service to tell me they charge a $50 non-refundable consultation fee before he would talk to me about his services (the fee would not go towards the retainer if I hired him). When I arrived in his office there was barely a place to sit, this man had stacks of clutter and paperwork all over every square inch of his 10'x10' closet of an office in an old decrepit 1/2 vacant 2-story office building, in a remote section of San Jose. CREEPY & BAD CHOICE.
3. The third attorney was a team of attorneys in downtown San Francisco operating in multiple counties and/or nationally, I'm not sure. They only quote price in person, not over the phone. Thinking third-time's the charm I hopped on BART and went to their San Francisco office. I was greeted by the receptionist who handed me a clipboard with instructions to complete 10+ sheets of questions and fill in the blanks for my Social Security Number, address, all contact information, current debts & creditors etc. When I asked the receptionist if I could instead see the attorney the reply was not until I completed the volumes of questions. Half an hour later I saw the next available attorney (a woman) who quoted me a laundry list of costs plus more than the first attorney above. Disheartened, I declined their offer and asked for my questionnaire back. Much to my dismay, she declined! I asked again, stating that I am not a client, implying I will never do business with them. She still refused, stating "oh we keep on file, in case you change your mind." I think that is wrong!
Depressed and not knowing where to turn, I came across Kendall's website and thought simple, not dissimilar to the other websites but okay with my experience with the other 3-attorneys I'll be able to make this a quick interview.
The rest is history. I am happy to share with you that Kendall charged me a price I was happy to pay, he was pleasant, kind, understanding, sympathetic to work with and patient beyond measure through my resistance to filing bankruptcy.
Kendall also went above and beyond the call of duty in my case because I made an error, and he risked asking the bankruptcy Trustee something on my behalf that I don't think any other attorney would be open-minded to try. The bankruptcy Trustee agreed to grant the request and voila, my case was heard and is now complete, I might add in the perfect time sequence.
If you are facing the only resort as to file BK and looking for the right attorney to serve your case I highly recommend Kendall Coffman. Call him. This may save you hours of grief.
